Legal Status of Foreign Nationals in Serbia: Guide to Rights, Obligations and Employment

The Republic of Serbia has in recent years recorded a significant influx of foreign nationals who come here for work, establishing a business, or family reunification. Whether you are coming to Serbia as an investor, highly qualified professional, or family member of our national, understanding domestic legislation is key to stable and lawful residence.
Legal Status of Foreign Nationals in Serbia is regulated by a set of systemic laws, of which the most important are Law on Foreigners and Law on Employment of Foreigners.
In this guide, Miković - Bosilj Law Office from Pančevo provides a detailed overview of the key rights, obligations, and procedures that foreign nationals must undergo in order to legally live and work in Serbia.
1. Entry into Serbia and First Obligation: Registration of Residence (Beli Karton)
The first step for every foreigner who enters the Republic of Serbia is registration of residence, colloquially known as "beli karton".
Time Limit for Registration: A foreign national (or the hotel/host at whose premises they are staying) is obliged to register residence with the competent police administration within 24 hours from the moment of crossing the border.
Importance: Beli karton is the fundamental document proving the legality of your current stay in the country and is necessary for all subsequent steps, such as opening a bank account or applying for temporary residence.
2. Types of Residence for Foreign Nationals
Depending on the purpose and duration of the planned stay, the legal status of a foreigner in Serbia may be channeled through three forms of residence:
Temporary Residence (D Visa or Residence Permit)
Temporary residence is granted to a foreigner who intends to stay in Serbia for longer than 90 days (or longer than the period determined by the visa-free regime). The most common legal grounds for obtaining this permit are:
Employment or work engagement.
Establishing a company (sole proprietorship or limited liability company) – a popular option for foreign investors.
Family reunification (if the spouse is a citizen of Serbia or a foreigner with approved residence).
Schooling, studies or specialization.
Purchase of real estate on the territory of Serbia.
Important note: Since the introduction of the concept of the Single Permit, the procedure has been significantly digitalized and expedited, which we describe in more detail below.
Permanent Residence
Permanent residence represents the highest degree of integration of a foreigner before acquiring citizenship. It may be granted to a foreigner who meets strict statutory conditions, with the primary condition being continuous residence in Serbia for a period of 3 years based on approved temporary residence (according to the latest legal amendments, instead of the previous 5 years).
3. Employment of Foreigners and the "Single Permit"
The greatest reform in the field of legal status of foreigners relates to the merging of the residence permit and work permit into one single document – the Single Permit for Temporary Residence and Work.
[Application is submitted electronically] ➔ [Ministry of Interior and National Employment Service conduct verifications] ➔ [Issuance of Single Permit]This procedure is now conducted entirely digitally via the eUprava portal, which has drastically reduced bureaucracy.
Conditions for Employers Employing Foreigners
If you are a domestic employer wishing to employ a foreign national, you must go through the labor market test procedure. The National Employment Service (NSZ) verifies whether there are domestic nationals on the unemployment register who meet the requirements for the specific position. If there are none, the employment of the foreigner is approved.
4. Right to Purchase Real Estate for Foreign Nationals
One of the most common questions our law office encounters is: Can a foreigner purchase an apartment or land in Serbia?
The answer depends on what type of property is at issue and from which country the foreigner comes:
Apartments and construction land: Foreign natural and legal persons may purchase residential and commercial properties subject to reciprocity. This means that citizens of Serbia have the same right in the country from which the foreigner comes. Serbia has signed reciprocity agreements with the majority of countries in the world (including Russia, EU member states, the USA, etc.).
Agricultural land: The law is considerably more restrictive. Foreign natural persons generally may not be owners of agricultural land, except under specific and strictly controlled conditions for EU citizens (subject to the condition of multi-year residence and engagement in agriculture).
5. Rights and Obligations: In What Respects Are Foreigners Equal to Domestic Nationals?
The legal status of foreign nationals in Serbia entails a high level of protection of rights, but also clear responsibilities:
Legal protection: Foreigners enjoy equal protection before the courts and state authorities of Serbia as domestic nationals.
Tax obligations: Foreigners who generate income in Serbia or possess property are obliged to pay taxes (income tax, property tax, contributions) in accordance with the tax regulations of the Republic of Serbia.
Misdemeanor and criminal liability: For violations of law, public order and peace regulations, or traffic regulations, foreigners are liable before the competent misdemeanor and regular courts. Ignorance of the law of the country in which you are staying does not absolve you of liability.
Why You Need an Attorney for Status Matters of Foreigners?
Although digitalization has expedited processes, Serbian immigration regulations still require precision. A misinterpreted legal basis, incomplete documentation when submitting an application for a Single Permit, or missing deadlines for registration may result in serious misdemeanor penalties, or even a ban on entry into the country.
